The identification of the attributes of the rule of law has always been a contested issue. Indeed, because the conceptualization of the rule of law is inherently linked with theory of the rule of law (itself an open, evolving concept) there is no point in arguing about the correct definition. I therefore follow the sage advice of Gerardo Munck and Jay Verkuilen not to insist that one correct definition of a concept exists, but to avoid the extremes of including too little or too much in a definition relative to our theoretical goals. See Gerardo L. Munck & Jay Verkuilen, Conceptualizing and Measuring Democracy: Evaluating Alternative Indices, 35 COMP. POL. STUD. 5,7-9 (2002).TAMANAHA, supra note 1, at 1. The degree of consensus about the desirability of the rule of law should not be overstated. Historically, Marxist and Fascist regimes rejected the rule of law as an Anglo-Saxon, Capitalist notion

In fact, the term is contested along several axes. Linguistically, the term "rule of law" is often equated with the concepts of l 'etat de droit, in the French legal tradition, Rechtsstaatlichkeit or Rechtsstaat, in the Germanic legal tradition, and estado de derecho, in the Iberian traditions, including in Latin America. Substantively too, the concept of the rule of law has been subjected to liberal, feminist, and socialist critiques. In the working documents of the Word Bank, as Faundez shows, preoccupation with the rule of law as a function of governance has mushroomed within the last decade. Faundez, supra note 32, at 569. A survey of the Bank's World Development Report, published annually reveals that between 1997 and 2002-03 alone the number of matters identified as important components of governance has almost tripled from 45 in 1997 to 116 in 2002-03. Id. Since virtually every aspect of governance has a legal dimension, he asserts, the expansion of the governance agenda brought about a corresponding expansion of the [Rule of law Enterprise] agenda. Id. On the origins and nature of the Washington Consensus, see JOHN TOYE, DILEMMAS OF DEVELOPMENT (2ND ED, 1993);

Diamond estimates that today at least 45 and perhaps as many as 60 [countries] are electoral authoritarian - roughly between a quarter and a third of all states. Diamond, supra note 59, at 27. Indeed, if one examines the entire spectrum of regime types that now exist between authoritarian regimes, on one side of the regime spectrum, and reasonably high quality liberal democracies, on its other side, at the beginning of the 21st century out of the world's total of 193 independent states, roughly one hundred, a majority, can be categorized as, at best, diminished subtypes of democracy.

See Carothers, supra note 6, at 7-8. This shortcoming is not confined to the rule of law field. As Carothers points out, [i]n the broader field of democracy assistance, the pattern has been for democracy promoters to translate the overarching idea of democracy into an institutional checklist or template that they can pursue through a series of specific aid initiatives. Similarly, rule of law promoters tend to translate the rule of law into an institutional checklist, with primary emphasis on the judiciary. Carothers, supra note 16, at 20.

Wade Channell, Lessons Not Learned about Legal Reform, in PROMOTING THE RULE OF LAW ABROAD: IN SEARCH OF KNOWLEDGE 137 (Thomas Carothers ed., 2006). Carothers observes, for example, Although some practitioners harbor no doubts and promote the rule of law abroad with a great sense of confidence, most persons working in the field openly recognize and lament the fact that little really has been learned about rule of law assistance relative to the extensive amount of on-the-ground activity. Carothers, supra note 16.

From hesitant, modest use in the early 1990s, the term has spread to permeate the policy-speak of all the main donor organizations. Whereas in 1997, the World Development Report (WDR) identified 45 reform items as relevant to good governance, for example, in the 2002-3 report the number had increased to 116. The change in rhetoric has also correlated with shifts in the Bank's funding priorities: while its lending to promote economic reforms fell by 14% annually between 2000 and 2004, lending under the banner of governance reform rose by 11% annually during the same period, and by 2004,25% of its lending was committed to law and public administration reforms in borrowing countries. The World Bank's Articles of Agreement explicitly bar decisions based on political considerations or political systems, as well as interference in domestic political affairs of its members. Article IV, Section 10 provides: Political Activity Prohibited: The Bank and its officers shall not interfere in the political affairs of any member; nor shall they be influenced in their decisions by the political character of the member or members concerned. Only economic considerations shall be relevant to their decisions, and these considerations shall be weighed impartially in order to achieve the purposes stated in Article I. Similarly, Article III, Section 5 (b) restricts political considerations in Bank financing: The Bank shall make arrangements to ensure that the proceeds of any loan are used only for the purposes for which the loan was granted, with due attention to considerations of economy and efficiency and without regard to political or other non-economic influences

In terms of allocation of human and financial resources as well, the rule of law orthodoxy is largely pursued via an economics prism, rather than a more overtly comprehensive political view of sociopolitical development. As Rose observes, for example: Most present-day legal assistance projects are designed to assist developing countries cope with this seemingly inevitable process of global economic integration in the post-Cold War era. Rose, supra note 91, at 94. Similarly, Golub comments that: The programs and goals that donors pursue in the rule of law orthodoxy are not confined to the economic sphere, although that is often the main focus of the multilateral financial institutions that are among the largest sources of assistance funds for rule of law work. A good example illustrating the phenomenon is found in Thomas Carothers's broad brush survey of the field, The Rule of law Revival, in which Carothers conceptualizes rule of law promotion as a branch of international development aid, writing: Most governments attempting rule of law reform are not doing so on their own. Assistance in this field has mushroomed in recent years, becoming a major category of international aid. With a mix of altruism and self-interest, many Western countries have rushed to help governments in Eastern Europe and the former Soviet Union carry out legal and institutional reforms. Russia's legal and judicial reforms, for example, have been supported by a variety of U.S. assistance projects, extensive German aid, a $58 million World Bank loan, and numerous smaller World Bank and European Bank for Reconstruction and Development initiatives, as well as many efforts sponsored by Great Britain, the Netherlands, Denmark, and the European Union. Asia and Latin America are also major recipients of rule of law aid, with a focus on commercial law in Asia and on criminal and commercial law in Latin America. Africa and the Middle East have received less attention.... A host of U.S. agencies underwrite such aid .... The rapid expansion of U.S. rule of law aid exemplifies the only partially successful U.S. response to the challenges of the post-Cold War era.... Almost every major bilateral donor, a wide range of multilateral organizations - especially development banks - and countless foundations, universities, and human rights groups are getting in on the act. In most countries, U.S. rule of law assistance is a small part of the aid pool, although Americans frequently assume it is of paramount importance .... Enormous amounts of aid are granted for writing or rewriting laws, especially commercial laws .... Aid providers are expanding their rule of law efforts to reach parliaments, executive branch agencies, and local governments. Assistance also extends to civil groups." As part of international efforts to successfully implement the 1995 Dayton Peace Agreement, an international High Representative has effectively ruled Bosnia-Herzegovina since 1997, with NATO, EU, OSCE and UN involvement. The High Representative's mandate was significantly strengthened at the Peace Implementation Council (PIC) meeting in Bonn in late 1997. Since 2002 the High Representative has double hatted as the EU's Special Representative (EUSR, reflecting a shift in strategy in which the EU has assumed greater responsibility to managing the trusteeship and intending to steer Bosnia-Herzegovina into eventual EU membership. While all regions (with the exception of the Middle East) have experienced a marked rise in the risk that autocracy will be sanctioned, substantial regional variation in the likelihood of sanctioning exists. A Latin American country which experienced a lapse in democracy in 2000, Marinov writes, had a greater than 80% risk of being sanctioned by outsiders.

Both the Council of Europe and the OSCE are formally committed to protecting and encouraging democracy, human rights and the rule of law among their members. The Council of Europe is Europe's oldest democracy and human rights monitoring organization. The Parliamentary Assembly of the Council of Europe is responsible for monitoring compliance with their commitments as members of the organization. The OSCE (formerly the CSCE) maintains a number of mechanisms, under its Human Dimension pillar of security, designed to socialize members into democratic procedures, protection of human rights and observance of rule of law principles.
