As noted by Marquardt (ibid 192-3), this appears to call into question the EU's capacity to enter into binding commitments. At the very least, it displays considerable distrust on part of the US as to whether the Member States will comply with agreements concluded under Art 24 TEU. Moreover, it is peculiar that most Member States have submitted the two agreements for parliamentary approval even though they do not consider themselves to be (prospective) parties to them. One explanation for this apparent inconsistency is offered by the relevant German legislation: The German Government considered that the two agreements became binding on Germany as a matter of international law following their signature in accordance with the procedure laid down in Art 24 TEU and therefore sought parliamentary approval for their 'binding effect' (Bindung) on Germany, rather than for the agreements as such.
