The other is the 1994 reprint of a book written by Professors McDougal, Laswell and Miller, originally published in 1967 (M. McDougal, H. Laswell and J. Miller, The Interpretation of International Agreements and World Public Order (New Haven, New Haven Press 1994)) I can only interpret this to mean that for Judge Schwebel, the relevant customary international law is that of 1969, not that of 1996, when his article was first published.
