MEJA's extraterritorial jurisdiction allows for the prosecution of contractors employed by the US Department of Defense in US federal courts. In an effort to enhance the accountability of military contractors, MEJA's jurisdiction was extended to all federal contractors (not just those hired by the Department of Defense) hired by a US department or agency in contingency operations such as Iraq and Afghanistan, provided that their employment 'relates to supporting the mission of the Department of Defense overseas'. The Act's extraterritorial scope of application, in particular, shows South Africa's determination to bring an end to mercenary activity and regulate private military contractors, not only when such activity takes place on its own territory, but also when its citizens are hired abroad.
