This proposition may not be accepted by all commentators. Those who are inclined to reject it should nonetheless reflect on the following. We, the academic community, regard our own views concerning the scope of Treaty provisions and the legitimacy of use of normative precepts in their interpretation, as a relevant factor in determining whether the judicial decision was intra or ultra vires.
