    • The impact of economic inequality on people's health can be observed both within and between countries and depends on various factors including governmental resources and priorities and the availability and affordability of universal or private health insurance coverage. Even if we acknowledge the importance and seriousness of health inequities arising at the national level, this paper will focus on the growing global health divide between populations of the nations of the North and South, discussing the possibility that this divide will be aggravated by the introduction of new medical technologies aimed at health improvement. Indeed, speaking for the majority, Justice McLachlin held that section 7 of the Canadian Charter does not imply positive duties on government to provide a basic decent standard of living (para. 76 et ss.). More recently, in Chaoulli v. Québec (Attorney General) 2005 1 S.R.C. 791, a majority of four judges against three decided that the right to life, liberty and security of persons also protected by the Quebec Charter include a right to efficient health care financed by the public or the private sector. In this decision, the Court did not impose positive obligations on government but instead opened the door to the private sector for health care delivery. However, in a 1997 case (Eldridge v. British Columbia (Attorney General) 1997 3 S.C.R. 624) the Supreme Court of Canada broadly interpreted the right to equality, a traditional civil right, to include an equal right to resources required to take advantage of public health services offered to everyone, without discrimination.     • Until now, very few courts have judicially reviewed the right to health, but there have been a handful of cases. For example, in a matter involving the Yanomami Indians, the Inter- American Commission on Human Rights (IACHR) concluded that in refraining from taking appropriate actions to prevent mining and other harmful utilisation of the rainforest, authorities failed to protect their people's health and cultural traditions: IACHR Res. No. 12/85, Case 7615 (Yanomami Indians v. Brazil), 5 March 1985, reprinted in Annual Report of the IACHR 1984-85, OEA/Ser.L/V/II.83, Doc. 14, corr. 1, at 33, 1 October 1985 quoted in Toebes, 'Towards an Improved Undertaking'. Another court decision related to the right to health took place in Canada, in 1997. The Supreme Court of Canada broadly interpreted the right to equality, a traditional civil right, expanding its protection to include an equal right to resources required to take advantage of public health services offered to everyone, without discrimination in Eldridge v. British Columbia (Attorney General) [1997] 3 S.C.R. 624. In this case, the Court held that the failure of the BC authorities to provide sign language interpretation to deaf patients violated the equality rights of disabled people to fully benefit from the medicare system. More recently, in Chaoulli v. Québec (Attorney General) [2005] 1 S.R.C. 791, the Supreme Court of Canada ruled that the Québec province's ban on private health insurance for services covered by the public universal system violates the right to life and to security protected by the Québec Charter.
