In this context, three acts of secondary legislation must also be mentioned which introduced a right of residence for economically inactive persons (Council Directive 90/364/EEC of 28 June 1990 on the right of residence, [1990] OJ L180/26; Council Directive 90/365/EEC of 28 June 1990 on the right of residence for employees and self-employed persons who have ceased their occupational activity, [1990] OJ L180/28; Council Directive 93/96/EEC of 29 October 1993 on the right of residence for students, [1993] OJ L317/59). These directives, which entered into force shortly before the introduction of Union citizenship after more than a decade of legislative procedure (cf Wollenschläger, op cit n 2 supra, at 101 et seq), constitute, on the one hand, a further step towards overcoming a purely market-oriented regime of free movement; on the other hand, the economic conditions of residence (sufficient means of existence; comprehensive health insurance) demanded by these directives were such as to show that the legal position of economically inactive persons lagged behind the position of market actors whose right of residence was not made subject to such conditions. All three directives have in the meantime been repealed by Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC, [2004] OJ L229/35.

The compatibility of this exclusion with primary law has been questioned by two recent ECJ judgements (Case C-138/02, Collins[2004] ECR I-2703; Case C-258/04, Ioannidis[2005] ECR I-8275) extending the jobseeker's right to non-discrimination (under the free movement of workers, Art 45(2) TFEU) to benefits 'of a financial nature intended to facilitate access to employment in the labour market of a Member State' provided that there is a 'connection between persons who claim entitlement to such an allowance and [the host Member State's] employment market'. A clarification was expected from the Vatsouras case; the court, however, distinguished such benefits from '"social assistance" within the meaning of Article 24(2) of Directive 2004/38' (ECJ, Joined Cases C-22 and C-23/08, Vatsouras and Koupatantze[2009] ECR I-4585, para 45).
