To the extent that the victim is a person, however, there is no reason why, everything else being equal, that person should not be permitted to participate in the criminal proceeding against the person charged with having committed a crime against her. The problem is, of course, that everything is not equal insofar as victim participation may interfere with the defendant's rights to a fair trial by improperly influencing the fact finder. An Account of the Alteration and Present State of the Penal Laws of Pennsylvania

Ironically, the gangs of wheelbarrow men were the first offspring of the punishment reform effort in late-eighteenth-century Philadelphia. From 1786 until 1790, four years before the opening of the "Penitentiary House," offenders convicted of noncapital felonies cleaned the streets of Philadelphia with "an iron collar around their necks and waist to which a long chain is fastened and at the end a heavy ball
