The UK government is said to have had inserted in the new Treaty of 2007, an 'opt-out' declaring that Charter rights do not bind British courts unless UK legislation had opted in to the relevant provision: See J. Hendy and M. Ford, ASLEF v UK (Institute of Employment Rights, 2007), p 9, n 19. If the UK is confident that the Charter has no legal effect, it is difficult to see why an express opt-out is needed - except in an effort to provide belt and braces.
