For the first time in 2013, the AIPLA cost survey separates the cost of defending NPE cases from the costs of all patent litigation. Not surprisingly (to us), the average cost of defending NPE cases is substantially less than the average cost of litigating a patent case. Thus, on balance, the 2011 AIPLA study costs should be higher than Bessen and Meurer's data. The fact that they are in line further supports the view that Bessen and Meurer's data is biased too high.
