This is an idealized picture. In reality, the determination of the full 3D band structure through ARPES is complicated by the fact that the wave vector component perpendicular to the surface is not fully conserved in the photoemission process: it broadens due to the finite final-state extinction length, and it distorts during escape into vacuum.
