Namely the GATS, the TRIMs and the TRIPs. Of these agreements, the GATS deals most directly with investment issues. Mode 3 applies to the supply of trade in services through "commercial presence", which is in essence an investment activity. Mode 4 may also be regarded as investment-related because it deals, inter alia, with the temporary entry of managerial and other key personnel. In accordance with the MFN obligation, parties to the GATS are committed to treating services and service providers from one Member in a no less favourable way than like services and service providers from any other as concerns measures affecting trade in services.

The number of such IIAs has increased dramatically in the last 20 years. Presently, there are estimated to be more than 2500 BITs and over 175 RTAs. While new agreements are still being negotiated (and many of the existing ones in the process of being renegotiated), the increase of BITs has slowed markedly in recent years. There seems to be an inverse relationship between the proliferation of regional trade agreements containing investment provisions and the conclusion of new investment treaties. Given the number of BITs reached already, there may also be a certain saturation effect.
