In its question, the national court referred also to Art. 12 EC, which lays down the general principle of the prohibition of discrimination on grounds of nationality. According to the ECJ, Art. 12 EC applies independently only to situations for which the Treaty lays down no specific prohibition of discrimination, and this principle has been given a specific expression and effect by Art. 49. It was for that reason unnecessary to rule on Art. 12 EC in this case.
