    • The Consent Problem within DNA Biobanks
    • The author describes this alternative as a form of 'waived consent', in which donors give authority to a representative in order to interpret their initial act of consent (Ibid: 516). However, this is not exactly the same as a 'consent waiver'. According to standard bioethics doctrine, in the exercise of a waiver the subject voluntarily relinquishes the right to an informed consent, and a general practice of allowing it is considered dangerous. (T.L. Beauchamp & J.F. Childress. 2001. Principles of Biomedical Ethics, 5th ed. New York: Oxford University Press: 92-93.) Shickle's 'waived consent' looks more like a sort of proxy appointment, as when a health care representative is appointed in advance directives. This appointment is not a waiver of consent, but a form of delegation of the power to uphold it in some circumstances.

    • It is generally considered that strengthening the relationship between research projects is a good thing in the context of R&D policies, so at least one thing is for sure: this condition of 'project relatedness' is not neutral or value-free.

The proposal concerning already collected samples adopted both in the law and in these IIER recommendations was first suggested in the literature in Spanish by Carlos M. Romeo-Casabona. 2002. Los Genes y sus Leyes [Genes and their Laws]. Bilbao / Granada: Cátedra Interuniversitaria de Derecho y Genoma Humano / Comares: 170ff, 173. This book is co-published by an Inter-University Chair which has served as adviser to the Spanish Ministries for Health and for Justice; therefore its influence on the drafting of the Act should not be excluded.
