This same attribution of impunity to the failure to prosecute informs Schabas's treatment of the case, though he is less definitive in dismissing Sudan's efforts to establish accountability mechanisms than is Human Rights Watch or the ICC Prosecutor. After citing Sudan's assertion that it was prosecuting crimes in Darfur in response to Moreno-Ocampo's June 2006 report to the Security Council, he suggests: "It may well be that, spurred by the Security Council referral, Sudan is doing an adequate job of addressing impunity.
