    • The first legislators to introduce legislation of this nature were those of Massachusetts who inserted s. 23D in chapter 233 of the State's General Laws in 1986 to provide that 'statements, writing or benevolent gestures expressing sympathy or a general sense of benevolence, shall be inadmissible as evidence of an admission of liability in a civil action, Taft (2000) discusses the history of this provision.
