    • The recent changes brought to PSSA Guidelines have had the effect of restricting coastal states' possibilities within the IMO to adopt innovative and proactive measures to control environmental risk in areas under their jurisdiction. The debate that took place at IMO level reflects the conflict of interests that exist between flag and coastal states with respect to the freedom of navigation, and innocent and transit passage in particular. See Roberts, supra note 34. This author, however, is of the opinion that these restrictions introduced at the IMO level will not deter coastal states from seeking to expand their legal jurisdication over coastal areas and that the debate will simply move away from the IMO.
