GATS Article 11:2 permits Members to maintain a measure inconsistent with this MFN obligation provided that it is listed in the Annex on Article II Exemptions. Although national exemptions to the MFN principle in specific sectors were permitted at the time of entry into force of the agreement (such exemptions are generally not to extend beyond 2004), any future requests to escape MFN obligations must follow the WTO waiver procedure. Another general exemption from the MFN principle is for regional trading arrangements, which is similar to the regional trading exemption in GATT.
