    • 11. Rule 7(4)(b) of the Rules of Procedure is applicable when national authorities “initiate” a procedure which might lead to the disqualification of a Member from holding office. When the national procedure is over, Art. 12 of the Act of 1976 becomes applicable. If this interpretation of Rule 7(4)(b) is correct, the President of the European Parliament, who was informed by the French Government on 25 April 2000 of the adoption of the decree of 31 March 2000, should not have referred to this Rule and thus should not have asked for the opinion of the Legal Affairs Committee, as she did on 3 May 2000.
