The statutes and regulations that govern FDNY require the online medical control physician decide whether it is appropriate to "terminate the resuscitation" according to guidelines and state the "time of death." This notation is used by the Office of the Chief Medical Examiner or by a private physician as the "time of death" for the death certifcate. Legally, the online medical control physician cannot "pronounce," "declare," or "determine" death, as that is done either by the medical examiner or by the private physician in the death certifcate.
