Regardless of whether the applicability of the Fairchild decision is limited to mesothelioma cases or not, it is clear that it would be extremely difficult if not impossible to meet the 'material increase in risk' in the context of climate litigation where even several joint tortfeasors' emissions are unlikely to cross the materiality threshold
