Case C-36/02, Omega Spielhallen-und Automatenaufstellung GmbH v Oberbürgermeisterin der Bundesstadt Bonn[2004] ECR I-09609. This case concerns a laser sport game involving the simulation of acts of violence against persons, in particular, the representation of acts of homicide, being banned as an affront to human dignity. In this case, the Court gave preference to dignity as protected in national law (German Constitution) against freedom of services and freedom of movement of goods. Advocate General Stix-Hackl states, 'There is hardly any legal principle more difficult to fathom in law than that of human dignity' (para 74, Opinion of Advocate General Stix-Hackl, Conclusions of 18 March 2004, in Case C-36/02).
