    • One issue that has not been fully explored is the extent to which an aggressive land bank strategy might run afoul of the Fifth Amendment. It is possible that an owner who loses his land to tax foreclosure could argue that the land bank's land-acquisition process fails to satisfy due process or amounts to a taking of private property for public use without just compensation being paid. This possibility must be kept in mind when structuring land bank legislation.
