10. Note: In March 2010 the European Commission proposed new legislation to deal with child pornography in the EU. The proposal pays particular respect to child pornography on the internet and comprises a general obligation for each member state to mandate access providers to block access to internet pages containing or disseminating child pornography [Art. 21 Proposal for a Directive on combating the sexual abuse, sexual exploitation of children and child pornography, COM(2010)94]. Such implementations shall be deployed additionally to actions aiming at the removal of content from host servers [Ibid, recital (13)]. According to the Commission, the removal of child pornography content at its source is difficult where the original materials are not located within the EU, hence also mechanisms should be put in place to block access from the Union's territory to internet pages identified as containing or disseminating child pornography [Ibid]. For that purpose, different mechanisms can be used as appropriate, including facilitating the competent judicial or police authorities to order such blocking, or supporting and stimulating Internet Service Providers on a voluntary basis to develop codes of conduct and guidelines for blocking access to such Internet pages [Ibid]. The proposal will leave it to the member states to decide exactly how the blocking should be implemented [Commission press release IP-10-379].
