Another remedy, bypassing the admissibility restrictions on direct actions, is for private parties to lodge a claim for damages against the EC institutions. Yet this can only be considered a remedy of last resort. When all is said and done, Community courts have rarely honored private damage claims; moreover, they seem inclined to narrow the circumstances in which such claims will be favourably reviewed. Recently, for instance, the ECJ held that the EC institutions were not liable for damages caused by legislative activity, in the absence of unlawful conduct (Joined Cases C-120/06 P & C-121/06 P, FIAMM and Fedion v. Council and Commission, judgment of 9 Sept. 2008, nyr, at para 175).
