Secondary audio programming (SAP) is a service for speakers of a second language, enabled by a control button on a VCR or television, provided the signal is in stereo, or a stand-alone SAP receiver. In 2003, SAP penetration, defined by Nielsen Media Research as the percentage of households that had an SAP-capable device, was 76.1%. One-third to one half of all TV broadcasters in the top Designated Market Areas were broadcasting on an SAP channel as of 2000. Memorandum and Order, FCC 03-218, 26-27 (Sept. 22, 2003). However, not all programs are necessarily available in SAP, just those the broadcaster decides to provide. So while some translated English language programming is available to some Spanish language viewers in some markets, this is by no means a universal or consistent service for all, so cannot be considered a substitute. Dissenting Commissioners Adelstein and Copps also argue that SAP service for news and public affairs programming is especially inconsistent, and that many broadcasters who originally offered SAP have now dropped it due to cost.
