The Joint Declaration spells out that the composition (the ratio of local and foreign judges) of the Final Court of Appeal will be determined by the SAR government. Yet China and Britain made a deal on the composition of the Final Court of Appeal in 1991 by deciding on the ratio of local and foreign judges as four to one.
