The relevant rule in Canadian case law requires application of the lex loci delicti commissi, which could be subject to a flexible exception in international cases. Section 145 of the Second Restatement adopts the most significant relationship test for the determination of the applicable law of torts. In the UK, Part III of the Private International Law (Miscellaneous Provisions) Act 1995 requires the application of the law of the country where the event occurs, subject to a rule of displacement.
