It is not just cases involving willful and particularly offensive discrimination that are subjected to liability. Given that "indirect" discrimination can be quite tricky, the result reached by the ECJ is not easily explained by an argument that it is "in the hands" of the employer not to discriminate; it seems more like a decision of public policy
