Based on Grotius's correspondence, some authors claim it was the VOC directors, while others opine that it was Oldenbarnevelt who earlier 'defended a similar case'. Fruin wishes to see a link between the writing of De iure praedae and Grotius's earlier output as a legal counsel while the 'Sta. Catarina incident' was pending before the Admiralty Court

In a letter to Heidelberg-based councilllor Georg Michael Lingelsheim, Grotius announces that he has 'finished' his work on the Indies affairs, but casts doubt over whether to publish the whole book or only the parts pertaining to the law of prize and booty
