Bulgaria was the first country to ratify the Accession Treaty on 11 May 2005; it was shortly followed by Romania on 17 May 2005. Interestingly enough, the first Member States to ratify the Accession Treaty were the newcomers of 2004 (Slovakia, Estonia, Hungary and Slovenia). The first old Member State to ratify the Treaty was Greece on 2 Nov. 2005. It merits attention that neither Bulgaria nor Romania decided to organize a nationwide referendum on the EU accession.

This factor gives a helping hand to some of the political elites who argue that future enlargements will not be possible without a prior deep institutional reform. This is the message coming from the European Commission's Enlargement Strategy published in late 2006. The Commission says: A new institutional settlement should have been reached by the time the next new member is likely to be ready to join the Union. See the Communication from the Commission to the European Parliament and the Council, Enlargement Strategy and Main Challenges of 2006-2007, cited supra note 4, p. 19

The early attempts were overshadowed by an unfortunate political decision to postpone the appointment of observers. Not only was it an embarrassing way to proceed, but it was also considered as a clear sign that the European Parliament had troubles accepting yet another group of observers. Under political pressure, the doors of the Parliament were finally opened to the observers on 26 Sept. 2005. The European Union stresses the strong elements of differentiation and flexibility in the arrangement for the free movement of workers. Member States shall endeavour to grant increased labour market access to Bulgarian nationals under national law, with a view to speeding up the approximation to the acquis. As a consequence, the employment opportunities in the European Union for Bulgarian nationals should improve substantially upon Bulgaria's accession. Moreover, the EU Member States will make best use of the proposed arrangement to move as quickly as possible to the full application of the acquis in the area of free movement of workers
