If golden shares are declared to be a barrier to freedom of establishment, why should a burden on a property, which may deter a potential buyer from another Member State from acquiring it, be considered any different?

Art. 44 (3) of the Rules of Procedure of the Court of Justice, in the version of the Amendments to the Rules of Procedure of the Court of Justice of the European Communities of 23 Jun. 2008 (O.J. 2008, L 200/20). A case will also be assigned to the Grand Chamber if a Community institution or a Member State, intervening in the proceedings before the ECJ, so request. Such possibility is, however, not open to individual parties, which may have interesting consequences for equality of arms before the ECJ in preliminary rulings, where Member States are often a party to the original proceedings before a Member State court.
