If the action is not carried out in the manner specified by the Minister, the person taking the action will only be guilty of contravening the Act if it can be proven that the action had a significant impact on a matter protected under Pt 3. That is, a substantive breach of the provisions of Pt 3 must be proven. It is not enough to simply prove the conditions have been breached. The, changed this by prohibiting a person from contravening a condition imposed under the manner specified process
