    • After the 2001 anthrax attacks, hospitals sought clarification from CMS about their EMTALA obligations if their staff encountered situations related to actual or potential biological agent exposure. CMS replied that all hospitals must meet their EMTALA obligations. However, the agency also stated that a hospital's transfer or referral of potentially exposed patients prior to the actual examination in accordance with a community response plan that designates specific facilities to handle certain categories of patients in bioterrorism situations would not violate its EMTALA obligations.
