    • In EC-Asbestos, the Appellate Body observed that the objective pursued by France, the preservation of human life and health, was a value that was 'both vital and important in the highest degree, and then went on to confirm that France could not be expected to employ any alternative measures that would entail an ongoing risk. Reference was made to Members, undisputed' right to set their own level of protection against risks. EC-Asbestos ABR paras 172, 174, and 168. In Brazil, Measures Affecting Imports of Retreaded Tyres, decided in mid-2007, the Panel recognized the seriousness of the diseases carried by mosquitoes breeding in discarded imported retreaded tires. The Brazil-Tyres Panel fully acknowledged Brazil's chosen level of protection, which was the reduction of the risks associated with waste tyre accumulation to the maximum extent possible, and this was respected in the Panel's reasoning under Article XXb, For example, see PR para 7.810
