    • The CBD has three main objectives: the conservation of biological diversity, the sustainable use of its components and the fair and equitable sharing of the benefits arising out of the utilization of genetic resources. It is a framework treaty that sets out several obligations aimed at implementing these objectives. These include obligations to create plans, strategies or programmes for conservation and sustainable use of biodiversity under Article 6. Similarly under Article 7, States must identify and monitor components of biodiversity important for their conservation and sustainable use, and identify processes and categories of activities that have, or are likely to have, significant adverse impacts on the conservation and sustainable use of biodiversity.

The CBD also provides that States have an obligation to take steps to regulate activities that threaten biodiversity, including through measures such as establishing a system of protected areas to conserve biodiversity under Articles 8, 9, 10 and 11. • For the purposes of Australian domestic law, the Australian Antarctic Territory is regarded as an external Territory and by virtue of section 5(1) of the Environment Protection and Biodiversity Conservation Act 1999 (Cth), the access and benefit-sharing regime would prima facie, as a matter of Australian domestic law, extend to the Australian Antarctic Territory.
