    • The hadd (arab. lit. border, plural hudūd] offences and their punishments are mainly deduced from the Qur'an and refined in the sunna or prophetic tradition. They are defined as infringements of the right of God (haqq Allāh) towards man and prosecuted by public authorities, which in practice makes them comparable to criminal offences in Western legal terminology.

On the other hand, one important ground of appeal against the stoning sentence inflicted on Safiyyatu Hussaini was the retroactive application of the Sokoto State Sharī'a Penal Code, since she had been arraigned before the bill was signed into law. It, therefore, appears that a continued application of uncodified ICL would have been contested on constitutional grounds.
