The wording of the statutes, namely Art. 25(3) of the Rome Statute, is not an argument for nor against the distinction between different modes of liability. While this article clearly distinguishes certain forms of participation, all participant are treated equally, i.e. like a perpetrator. Of course, this does not prevent the judges from basing the length of the sentence on the mode of liability.
