Both Tribes and lenders should proceed with considerable care before taking such a step, though. Realistically, non-Indian lenders are not likely to be sanguine about owning an asset under tribal jurisdiction without certain assurances as to their rights as landowners. Tribes may find that they have to make assurances regarding their use of their authority to tax and regulate lands within their authority. Further, some tribal courts may lack jurisdiction over disputes arising from contracts between Indians and non-Indians, or may simply lack the experience and capability to entertain commercial litigation. Tribes may find that, in order to attract lenders to the reservations, they will have to agree to alternatives to litigation in tribal court. Some will decide that this is too high a price to pay. Both are legitimate choices, and the decision should be up to the Tribes.
