In his Notes on the Indian Penal Code (1837), Thomas Macaulay had argued on political grounds, rather than anatomical grounds, that "Englishmen of lawless habits and blasted character" should be transported from India rather than imprisoned because he believed that: "our national character should stand high in the estimation of the inhabitants of India. . . . that character would be lowered by the frequent exhibition of Englishmen of the worst description, placed in the most degrading situations, stigmatised by courts of justice." This argument that Europeans in India could not tolerate imprisonment persisted into the twentieth century
