This is not to deny that a defendant, under section 107(b), may seek to escape liability by demonstrating that release and the resulting damages or costs were caused solely by an act of God, an act of war, or a third party who is unreleased to the defendant. Thus, a defendant might escape liability if there is truly no nexus between the defendant's conduct and the release that causes response costs, but as an affirmative defense, it is the defendant who bears the burden of proof on that defense, not the plaintiff, and it will only succeed if the defendant can show, among other things, that the release and the resulting damages are entirely attributable to God, war, or third parties. As indicated infra, sewer system operators have used this defense with mixed results.
