The notes taken by one of the authors (Prof. Reid) at a meeting held in September 1994 by the Nature Conservation Working Group of the UK Environmental Law Association show that in discussing the extent to which the draft Regulations did implement the Directive, the flaws identified included the absence of monitoring obligations, the inadequacy of provisions for marine conservation and the fact that the exception for harm caused as the incidental consequence of lawful operations was 'far too wide', all defects now confirmed by the Court.
