    • All professionals are likely to perceive that they are being accused of incompetence rather than just of making a mistake when a malpractice claim is asserted against them. The sense that this is overkill may explain, in part, why judges are reluctant to sanction attorneys for filing frivolous lawsuits. Physicians and other health care professionals are unique, however, in that their malpractice victims typically suffer significant physical injury.
