Kent v Griffiths [2001] QB 36
-
Kent v Griffiths [2001] QB 36 where the Court of Appeal held a duty of care arose where the ambulance service accepted a call requesting an ambulance, but failed to respond promptly to the call, with the claimant suffering resultant injury. The court left open the question whether an action could be brought where there were insufficient resources to provide enough vehicles or manpower (see at para 47). This would be an allegation based on Grubb's second category.

Paschim Banga v State of West Bengal [1996] ICHRL 31
-
Paschim Banga v State of West Bengal [1996] ICHRL 31, in which an Indian court found that an individual's right to life was breached when state hospitals failed to admit him even though he was in need of immediate medical treatment for a serious head injury and financial considerations did not prevent such an obligation arising. In Soobramoney v Minister of Health (1998) 4 BHRC 308 it was held there was no violation of a constitutional right to life of a patient with chronic renal failure denied dialysis treatment due to hospital budgetary constraints.
