Such extradition requests were presented to Argentina by Spanish Judge Garzón on several occasions between 1997 and 2001, formally backed by Spain in July 2005, by Italy and France in 2001, and by German courts in 2001 and 2003. These requests were all rejected. Some Argentine former military officers have been convicted in absentia in France (Alfredo Astiz, convicted in 1990 for his involvement in the disappearance of two French nationals) and in Italy (Suarez Mason and six others were convicted in Rome in December 2000). In Spain Adolfo Scilingo, who voluntarily came to Spain, was convicted for crimes against humanity in April 2005. The trial of Ricardo Miguel Cavallo, extradited by Mexico to Spain in June 2003, is still ongoing;

Justice Maqueda referred to the definition of jus cogens given by the IACHR, according to which jus cogens derives from ancient legal concepts of a superior order which the laws of man or nations cannot contravene; in this definition, jus cogens norms are rules which have been accepted either explicitly by treaties or tacitly by custom in order to protect the public morals recognized therein (Report No. 62/02, case 12.285, Domingues v. United States, 22 October 2002). While referring to Art. 53 of the Vienna Convention on the Law of Treaties, he states that an imperative international public order prohibiting certain crimes already existed prior to the Second World War. In his view, jus cogens is subject to an evolution whereby there has been an increase in the number of crimes so atrocious that they cannot be tolerated any more or go unpunished. Justice Maqueda refers to authors including Bassiouni and Cassese to support his opinion that the prohibition of crimes such as genocide, war crimes and crimes against humanity has evolved into a norm of jus cogens (at §49).
