Advocate-General Moltmaker concluded to dismiss the appeal, since articles 6 and 8 ECHR or any other convention's provision, including articles 9 and 12 of the Convention, in his opinion hold no obligation to hear minors below the age of 12 years, especially when in no way appeared that the child expressed a wish to be heard. The Supreme Court agreed with this conclusion. In an earlier phase the Court of Justice (on April 26, 1993) remarked, in response to the alleged violation of the Convention, that the Convention at that point in time still had not entered into force for the Netherlands.
