The Treaty on European Union, (Maastricht Treaty) does not affect the existence of the three European Communities: the European Community (formerly the European Eco-nomic Community), the European Coal and Steel Community and the European Atomic Energy Community. In accordance with a resolution passed by the European Parliament on 13 March 1978, the term "European Community" will apply to all three Communities in the following study. See European Parliament Resolution, OJ (EC) No. C 63/36 of 13 March 1978; Oppermann, Europarecht, München 1991, Rn. 141;

The term "European Union", which is also used in the current work, includes the three Communities (the so-called first pillar) in addition to the coordination of Member State domestic and foreign policy outside the scope of the Treaties (the so-called second and third pillars). The Union, by contrast to the Communities is not a legal person. See Beutler/Bieber/Pipkorn/Streil, Die Europäische Union, 4th ed., Baden-Baden 1993, p. 41. 74.

Controlling the allocation of subsidies is hindered chiefly by the fact that the control mechanism based on the principle of reciprocity present in normal contracts is absent here. See below at III.A.I.
