It has been held that in the case of persons who lack mental capacity, the common law doctrine of necessity might authorize detention of a person who is a potential danger to himself or others (R v Bournewood Community and Mental Health NHS Trust, ex parte L [1999] AC 458). However, this doctrine has not been extended to persons who are capable of refusing to be detained. The doctrine of necessity when used to justify detention may well be challengeable under the Human Rights Act.
