The main reason for this willingness is, in my opinion, not the mere existence of provisions on compulsory licenses but the understandable interest on the part of businesses to negotiate privately the amount of the license fees and the remaining licensing conditions with their contractual partners. This is preferable to disclosing to an authority or a court internal business matters, e.g., the amount of R&D costs, in order to determine a reasonable license fee, and have to accept the amount based on such disclosures.
