It should be noted that although Justice Bigger's decision did not explicitly mandate the closure or merger of HBCUs with HWCUs. It did however provide the state of Mississippi the latitude to do so if it is later determined by a monitoring committee that the merger of Mississippi Valley State University (an HBCU) and Delta State University (an HWCU) is the only feasible solution to promoting desegregation among public colleges/universities in the state of Mississippi. Justice Bigger's decision only made clear that the state of Mississippi had no constitutional obligation to close or merge HBCUs with HWCUs. See Ayers, 879, F. Supp. 1419.
